Award of John Salusburie, knight, and Symon Thelwall, gent., in the dispute between John Salusburie, esq., the son of Robert Salusburie, esq., and Thomas Lloid ap David Lloid of Llanguiven, co. Denbigh, gent. The said John Salusburie shall enjoy the parsonage of Llanynys from the Feast of Phillip and James the Apostles next ensuing the above date for three years yielding £30 annually to Thomas Lloid, and for that John Salusburie has held the parsonage for a whole year they award that he shall pay to Thomas Lloyd £40 (for the farm of the parsonage £30 and for the annuity or pension issuing out of the same unto Thomas Lloid £10). They award that Thomas Lloid shall enjoy the parsonage of Llangwiven from the said Feast for the next three years paying therefore to the said John Salusburie £6.13s.4d. annually. John Salusburie shall pay Thomas Lloyd an annuity of £10.13s.4d. out of the parsonage of Llanynys from the said Feast for the next three years, John Salusburie shall pay to Thomas Lloid £33.4s.8d. of old debt due upon Robert Salusburie, esq., for the parsonage of Llanynys. Award of Robert Merton and John ap Robert ap John, gentlemen, in the dispute between Foulke Fraunces and Thomas David both of Lleweny, co. Denbigh, yeomen. Thomas David shall make a 'flodeart' or a sluice of a yard broad to receive the water called Banaster into his lands and so continually keep the same so that Faulke Fraunces shall sustain no loss thereby. Faulke Fraunces shall likwise make a sluice upon his own lands to receive the said water into his lands and keep it sufficiently repaired so that the said Thomas shall sustain no loss by reason of not doing so. The said Fowlke Fraunces shall forthwith cast down the new ditch which he has made upon the lands being in the possession of the said Thomas and Fowlk and Thomas shall hedge and tine every one his part of the hedge between them in variance and the same sufficiently keep from time to time so that neither party shall sustain any loss thereby. The said Fulk Fraunces shall deliver to the said Thomas David two 'lames' or else the sum of 3s.4d. for the same at the feast of the Apostles Peter and Paul next ensuing the date hereof. Award of Robert Salusbury of Denbighe and Thomas Salusbury of the same, esquires, arbitrators in the dispute between John Salusbury of Llewenie, co. Denbigh, esq., on the one part and Roger Salusbury of Bachegreg, co. Flint, esq., and George Salusbury of Erbistocke, co. Denbigh, gent., on the other part. They award that the said John Salusbury shall quietly enjoy all the messuages, lands, etc., which Sir John Salusbury, knight, and Dame Jane his wife, both deceased, were seised of in the townships of Aberchwilar, Llanrhayader, Tre yr llann, Tre r lloyn, Tre r llech, Boderwog and Bachkerne, co. Denbigh, with further assurance from the said Roger Salusbury and George Salusbury; that the said John Salusbury shall quietly enjoy all the copyholds, term or leased lands of Sir John Salusbury and Dame Jane his wife in the townships, fields, hamlets and parishes of Erbistock, Iscoed, Abynbury, Marchwiel, Borras, Borras Hoove, Borras Gruffrie, Gresford, Gwersillt, Stansty, Stansty Ucha, Stansty issa, Brymbo, Broughton, Christionydd, Morton Wallicorum, Rhiwabon, Christionydd, Kenverick, Rhiwallt, Burton and Llay, in the hundred and lordship of Denbigh, cos. Denbigh and Flint, or that Sir William Norris, knight, deceased, or Edward Norris, esq., now, living, or David Massie possessed by grant of the Queen and have assigned to the said Sir John Salusbury or Dame Jane his wife, or were afterwards assigned by the said Dame Jane in her widowhood to Robert Wynne, esq., Thomas ap Morgan, clerk, and David Mredyth, gent., without hinderance of the said Roger Salusbury and George Salusbury; the said Roger Salusbury and George Salusbury shall enjoy the messuages, lands, etc., which Sir John Salusbury and Dame Jane were seised of in the last mentioned townships, etc., in the hundred and lordship of Bromfild, co. Denbigh and Flint; they shall pay to the said John Salusbury £100 in two equal instalments. Witnesses: Robert Salusbury, Edwarde Salusbury, John Conway, F. Award of Sir John Salusbury, knight, chamberlain of North Wales, arbitrator in the dispute between Thomas Morice ap John ap Meredith of the parish of Llanvair in Deffrencloyd, co. Denbigh, gent., and John ap John ap Madog of the town of Ruthen, co. Denbigh, burgess, concerning a meadow called Tall y Llyn adjoining the 'barnemylle' within the liberty of the town of Ruthen. He awards that the said Thomas ap Morice shall peacefully enjoy half of the said meadow for the present year paying to John Salusbury, esq., son of Robert Salusbury, esq., deceased, for the same year 10s.; that the said John ap John shall have one half of the said meadow for this one year paying to the said John Salusbury 10s.; that the said Thomas ap Morice shall have the meadow wholly to himself for the space of two other years paying to the said John Salusbury 20s. per annum; neither afterwards shall claim any right in the meadow but permit the said John Salusbury to have the same as in his former estate. Bill Of Complaint of David Roberts of the parish of St Asaph, co. Flint, and Katherin his wife to Henry, Earl of Pembrocke, Lord President and others the Queen's Majesty's Council in the Marches of Wales, against Maxemillian Smyth, John Salusbury of Llewenny, Harry ap Harry, John Pitchardes, John ap Hughe, Robert ap Hughe, Edmund Huxley, Samuell Price, John Cuttler, David Millner, John Huxley. John Salusbury of Denbighe, son of Thomas Salusbury, esq., deceased, was seised of a meadow called the Deans meadowe in the tenure of the said John Salusbury in Llewenny. About 23 Jan. 1560/1 he bequeathed the moiety of the said meadow to Thomas his son, with remainders to Hughe, John, Elizabeth and Jane (born before he married his wife), Margaret, Ellen, Anne, Katherin and Mary Salusbury, his sons and daughters, Thomas Salusbury of Flint, and the heirs of John Salusbury, knight, successively. Thomas Salusbury, the son and father of the said Katherin, wife of David Roberts, entered the moiety and occupied it for 15 or 20 years without interruption. The same John Salusbury conveyed it to Robert Wynne ap John ap Rees and Humffrey Cloughe, gent., feoffees, to the use of Thomas Salusbury for life and after his decease to the said Katherin Salusbury, eldest daughter of John Salusbury. At his death Katherin entered the premises. She married David Roberts. About July last 'was ii years' the defendants got some of the assurances relating to the moiety into their hands and in unlawful and riotous sort with various weapons forcibly entered about 5 acres (value £5 by the year) of the moiety of the meadow of the north side thereof, now severed with a hedge and ditch from the other part of the moiety, and broke the iron lock of the gate, and the hooks and hasps. Maxemillian Smyth and John Salusbury assaulted Homffrey Cloughe, the tenant. A bill was exhibited against defendants about June last for wrongful entry, unlawful assemblies, and some of the defendants fled to London, etc. In March last some of the defendants compacted with John Salusbury of Llewenny, esq., for a bargain of the title to the premises and entered the premises and retained the evidence relating to the same. Request process against defendants. At Ludlow, 1 June 1597, before the President and Council in the Marches of Wales the matter was continued until 20 July next and ordered that the bill be directed to Henry Tounsed, one of the Justices of Assize of co. Denbigh and one of the Council in the Marches, to compose the matter or if he fails to take answer of the defendants. [3.148].
