William Powell v. William Thomas,

A file of depositions of witnesses in the suit in the Council in the Marches of Wales, between William Powell, esq., complainant, and William Thomas, gent., defendant, containing:. (I) Depositions on behalf of complainant at the church of Newchurch, 5 December 1604, before George Morgan and John Williams, Commissioners: (a) Henrye George of Llansoy, yeoman (70) with other went to complainant and defendant to make conclusion and agreement between them and by enreaty brought them together near plaintiff's dwelling house in Llansoy and it was fully agreed that defendant should assure and release the premises to complainant and was present on the premises when defendant by "sprigge and turff" executed livery and seisin to complainant, which was done by word of mouth and by no writing. Also agreed that complainant should release defendant of all former debts and gave him a 21 years lease, at yearl rent of £3, defendant to do suit of mill. Defendant had made default of the £3 rent and all other duties. (b) Thomas Reynolds, of town of Chepstowe, yeoman, (75) was told by an honest woman of the town of Chepstowe who had heard in the town of Ragland, that defendant intended on the Feast of the Purification to go to the church of Wolffesnewton, with many persons in his company including two from out of the county of Glamorgan, and defendant was asked by complainant to come to the church yard or church porch of Wolffesnewton at the intended time and he was there with the complainant's friends in company when defendant and his friends came armed. Defendant used to the complainant divers ill and indecent speeches, defendant did not show, tell or number any money, but he did show a bag. (c) Lewis Thomas of the parish of Langoven, yeoman, (60). David Thomas of Llangoven, yeoman (40), was requested by complainant to be at the parish church of Wolffesnewton to bear witness that there should be no injury or harm offered complainant by defendant. (d) John Parry Of Llansoye, Yeoman (52). William Nicholas of Llansoye, gent., (55). William Powell v. William Thomas Morgan,

A file on the suit in the Council in the Marches of Wales between William Powell of Llansoye, esq., complainant, and William Thomas Morgan of Llansoye, defendant, containing:. (1) Bill of complaint. Defendant, seised in fee of 2 closes of land called Kay tyr y Kilocke and Gworlod tyre y kylock, in the parishes of Llansoye and Llangme, in October 1593 conveyed the same to complainant with provisio that the defendant paid complaint £30 with costs on the feast of the Purification 1596/96 in the porch of the parish church of Wolfesnewton, complainant should reassure him the premises. For a further sum of money advance defendant in January 1594 conveyed the premises to complainant who leased the same to defendant the rent for which defendant has refused to pay. At end of the bill a note in the hand of William Powell of a full agreement made 9 June 1596, between him and William Thomas Morgan. (2) Answer of defendant, 24 July 1604. On the day appointed he repaired to the church porch of Woulfesnewton with the mortgage money, with about the sum of £5 more to cover charges which he did not think exceeded 5s., plaintiff intending to procure a forfeiture, made a confederacy with some of defendant's adversaries, and caused him to be outlawed, and arranged for the bailiff to come to the church porch at the time defendant was to pay the mortgage money. Nevertheless defendant offered him the mortgage money, with the charges, which were in a bag which he opened and showed complainant who would not accept the same unless defendant told and numbered the same, which he dared not do because of the officers. This was the only reason the money was not then paid. On his tender of the money defendant requested the complainant to reassure him the premises, which complainant refused to do. Defendant has divers times since offered to pay the moiety of the money and charges but complainant has refused to accept. Defendant contented to do the same with such damages as the Court shall award. (3) Replication of complainant. The charges amounted to 40s. (4) Certified Copy of Process at Ludlowe, 15 October 1604. Ordered that the matter be continued to 19 January next and commission to examine witnesses at the parish church of Newchurch to Henry Rumsey and others, to deliver to defendant 10 days before day appointed for meeting a precept from the Court, etc. (5) Process at Bewdly, 4 August 1604. Draft order for commission to examine witnesses. Endorsed with a note that the precept from the Commissioners was delivered to defendant 24 November 1604. (6) Copy of precept by John Williams to William Thomas Morgan of Lansoy dated 20 November 1604 to meeting in the parish church of Newchurch, 5 December next. (7) Note of hearing, 17 July 1605. (8) Process at Ludlowe, 29 January 1605. Order that publication of the parties witnesses be granted and matter continued to 17 July 1605.

William Herbert, esq's petition re. Sir Walter Raleigh,

A draft or copy of the petition of William Herbert, esq., to James I that he laid out £2200 in the late voyage of Sir Walter Raleigh, and has now to stay in London by order to attend the Council's pleasure 'to his great charge and hindrance, having his wife and family in Wales,' but during the attendance he had discovered Sir Walter Raleigh's intention to escape out of the realm and had informed the King by Sir William St John, and that the ship 'Destiny' should be transferred on him, or other satisfaction.
