The case relates to the purchase by the appellants of a quantity of government surplus tinned soups lying at HM Depot, Deptford, 1919, the remainder of which (c.16,000 cases) they sold in May 1920 to W. Archer & Co. Ltd, financed by eight bills of £1,000 each and one bill of £117 6s. 4d., payable in six months, guaranteed by Nash & Co. of Cambrian Mills, Newtown, co. Mont., the respondents, a partnership of four, Nash, father and son, chemists, and a retired farmer and an auctioneer, the partnership having been formed to deal in government stores.
