Mont., gent. and Elizabeth, his wife. 2 Rice Williams of the town of [Welsh]pool, gent., sole executor of the last will and testament of his brother, Edward Williams, late of the same place, gent., dec. and his residuary legatee. 3 Richard Evans of the town of [Welsh]pool, gent. 4 Walter Thomas of Chester, esq. 5 John Williams of [Welsh]pool, gent. Assignment Of Mortgage by 2 to 4 by the direction of 1, of m's called Tyddyn Gyfylche, alias Ty yn y Gyfylche and Ty yn y Fron in p. Llanerfyl, co. Mont. with Further Mortgage (Release) For £47 by 1 to 4 and Assignment by 3, who is trustee of 2, to 5 of the residue of the term of 900 years in trust for 4 for the better securing of repayment. Consideration: £303 for the assignment and £47 for the further mortgage, making a total of £350 to be repaid with interest. Recites: Indenture of 29 September 1776 between 1, 2 and 3, reciting nos 288-9 above, that Evan Griffith had died, leaving G. E. his sole son and heir, a further mortgage for £198-8-0 dated 6 Sept. 1756 reciting nos 288-9, that G. E. had defaulted in repayment of £200 and interest, thus owing 1 £200-12-0, declaration of uses of a fine, a further mortgage for £50 (4%) dated 10 Aug. 1763, nos 290 and 291 above, stating that the total sum owed by G. E. was then £660; a lease and release by 1 to 2 at the direction of E. W., dated 29-30 May 1772, reciting that the £660, together with £71-15-6 interest and another small loan of 4/6, made a total of £732 owing to E. W. and to 2 as his trustee; that E. W. died, and by his will of 30 Jan. 1771 appointed 2 his executor and residuary legatee, by which 2 became entitled to the said recited securities, and reciting a deed poll endorsed on the release of 30 May 1772, noting an account settled between 2 and G. E. by which there appeared to be due to 2 two years' interest of £65-17-4 which with the principal sum and a further loan of £2-2-8 made a total of £800 owed, and that G. E. covenanted with 2 that the premises should not be redeemed until the money is repaid, and reciting that G. E. had contracted with 2 for the absolute sale to him of Caerguyddion and Tyddyn Bach in t. Moelfeliarth, p. Llangdafan, being part of the mortgaged premises, for £600, and that to date the total sum owed was £886-8-7; that 1 bargained and sold the said premises to 2; that 2, at the direction of 1, assigned to 3 the m's called Caerguyddion, Tyddynbach, Guyfylche and Tynyfron for the residue of the term of 900 years, free from provisos and equity, but upon trust to attend the inheritance for 2; that the m's called Tyddyn y Gyfylche or Ty yn y Gyfylche and Tynyfron and all premises not purchased by 2 are in trust for him for the better securing of the repayment of the remaining £286-8-7 (4½%) and after the repayment thereof in trust for G. E., the fee simple being with 2 as trustee of E. W., and the same premises being vested in 3 as trustee for 2 for the residue of 900 years; that there is now owing to 2 the principal sum and interest of £303, which 1 has requested 4 to advance, with a further sum of £47, which 4 has agreed to do upon having an assignment made to him, which sums make a total of £350. Seals. Endorsed: Notes of interlineations in the text, receipts by 2 for £303 and G. E. for £47, and in a later hand, '11'.
